LEASE TERM

This Faculty/Staff Housing Contract is between DRURY University (“DRURY”) and the person who filled out this form (“RESIDENT”) for rental of the residential premises owned by DRURY and located in either Manley Hall or Jefferson Park (“the Premises”). The unit will come furnished with the typical student furnishings, and includes trash service, utilities, basic maintenance, basic pest control, wifi, and access to the community laundry facility.

1. LEASE TERM
This Contract is in effect according to the start and end date determined above, as long as the RESIDENT is employed by DRURY University (“DRURY”). If RESIDENT’s employment by DRURY is terminated for any reason, RESIDENT must send written notice to the Housing Office immediately, then clean and vacate the Unit, and turn in keys to DRURY Security within fourteen (14) days of RESIDENT’s last day of employment. For reasons other than employment separation, RESIDENT agrees to give the Housing Office thirty (30) days written notice prior to vacation to cancel earlier than contracted. In the event this Contract is terminated prior to the Contract Term, for any reason, monthly rent will be prorated by night and RESIDENT will lose their housing deposit.

2. HOUSING DEPOSIT
A housing deposit of $200 is required for residents staying longer than 30 days before collecting keys to the unit. In the event this Contract is terminated prior to the Contract Term, for any reason, monthly rent will be prorated by night and RESIDENT will lose their housing deposit. The deposit may be paid at the Housing Office by cash or check made payable to DRURY University. The $200 housing deposit will be returned to the RESIDENT by check within thirty (30) days after the premises have been vacated except that DRURY may retain any portion of the deposit, in DRURY’s sole discretion, necessary to cover a) any unpaid rent, b) cleaning costs, c) key replacement cost of $50 per lock, d) cost for repair of damages to premises and/or common areas above ordinary wear and tear, and e) any other amount legally allowable under the terms of this Contract. A written accounting of said charges shall be provided to RESIDENT within thirty (30) days of vacation. If deposits do not cover such costs and damages, the RESIDENT shall immediately pay said additional costs for damages to DRURY. As set out in Section 1, DRURY will retain the entire housing deposit if this Contract is terminated for any reason before the stated Contract Term. Before moving in, the RESIDENT agrees to pay the first month’s rent.

3. RENT PAYMENTS AND CHARGES TO DRURY ACCOUNT
In addition to the $200 housing deposit, RESIDENT agrees to prepay the first month’s rent of $700 (or less if the move-out date) before RESIDENT may collect keys and move in. The first month’s rent may be paid at the Housing Office by cash or check made payable to Drury University. RESIDENT authorizes DRURY to charge a $700 per month after-tax payroll deduction for rent. RESIDENT authorizes DRURY to charge the RESIDENT’S Drury account to cover a) any unpaid rent in the event the RESIDENT does not move out at the expiration of the contract, b) cleaning costs, c) key replacement or lock core replacement costs if keys are not turned in, d) cost for repair of damages to premises and/or common areas above ordinary wear and tear, and e) any other amount legally allowable under the terms of this Contract. A written accounting of said charges shall be provided to RESIDENT within thirty (30) days of vacation. The RESIDENT shall immediately pay said additional costs for damages to DRURY. RESIDENT agrees to pay interest of 1% per month, collection costs, and legal fees on unpaid balances. In the event RESIDENT has dogs and/or cats, RESIDENTS agrees to pay the $25 per month pet fee, via post-tax payroll deduction.

4. PET DEPOSIT & PET FEE
RESIDENT may have up to 2 pets in the Premises for additional pet fee of $25 per month—species limited to cats and/dogs. RESIDENT shall pay a NON-refundable $300 pet deposit, which may be paid to the Housing Office by cash or by check, made payable to DRURY University. RESIDENT must sign a pet addendum with this contract prior to bringing a cat or dog to the Unit. Fish are allowed in a 10-gallon tank for no additional fee or pet addendum. Different types of animals may be requested in writing at the Housing Office & approved with a pet addendum, but the total pet count shall not exceed two (excluding fish). Such consent shall be revocable in DRURY’s sole discretion by giving a 30- day written notice to RESIDENT except in cases of immediate threat to health, safety, or property, in which case revocation shall be effective immediately upon written notice to RESIDENT. RESIDENT also agrees to carry insurance to cover injuries, losses, or damages to persons or property that may be caused by such animals.

5. PROHIBITIONS
The Premises may not be used as a location for the operation of any business or enterprise; or for the sale of any services or products.

RESIDENT agrees not to cause or allow any noise or activity at the Premises which might disturb the peace and quiet of another RESIDENT and/or neighbor.

DRURY is tobacco-free. Smoking (or vaping) of any kind, chewing tobacco, etc. is prohibited in or around the Premises.

6. OCCUPANTS
Guest(s) may not stay at the Premises for over fifteen (15) days without the written consent of DRURY. Any individual not named as RESIDENT or additional tenant in this Contract shall be considered a guest.

7. DESTRUCTION OF PREMISES
If the Premises is totally or partially destroyed during the term of this Contract so that RESIDENT'S use is seriously impaired, DRURY or RESIDENT may terminate this Contract upon three (3) days written notice to the other.

8. CONDITION OF PREMISES; PROPERTY MAINTENANCE
RESIDENT agrees to complete a Room Inventory Condition (RIC) form upon move-in to be filed in the Housing Office. Any items in the Premises not in good working order should immediately be reported to Facilities (930 N. Clay, 417-873-7219) for maintenance or repair. During the term of the contract, RESIDENT agrees to keep the Premises in good condition, by immediately reporting all broken or damaged appliances, fixtures, pest control issues, or any other damages of any kind to the Premises to Facilities. If RESIDENT makes a report to Facilities, such report constitutes permission by RESIDENT for the appropriate staff to enter the Premises during business hours until the work order or issue has been resolved. RESIDENT shall deposit all garbage and waste in a clean and sanitary manner into the proper receptacles and shall cooperate in keeping the garbage area neat and clean. RESIDENT shall be responsible for disposing of items not accepted by the garbage hauler. RESIDENT shall be responsible for keeping the kitchen and bathroom drains free of materials that may tend to cause drain clogging. Animals should not be washed in university sinks, showers or bathtubs. RESIDENT shall pay for maintenance or repair of any plumbing fixture damaged or clogged and for the expense or damage caused by stopping of waste pipes or overflow from bathtubs, wash basins, or sinks.

RESIDENT agrees to pay for costs to repair and/or replace any appliances, fixtures, ceilings, walls, carpets, blinds, windows, doors damaged by RESIDENT, additional tenants, or RESIDENT’s guests, invitees, or pets. At the termination of this Contract, the Premises and garage (if applicable) shall be returned to DRURY in the same condition as when RESIDENT first occupied the Unit, except for reasonable wear and tear. It is agreed that all dirt, holes, tears, burns, and stains of any size or amount in the carpets, walls, fixtures, and/or any other part of the Premises do not constitute reasonable wear and tear. The Premises shall be returned to DRURY free of all of RESIDENT’s personal property and trash.

9. ALTERATIONS
RESIDENT shall not paint, wallpaper, alter or redecorate, change or install locks, install antenna or a satellite dish, or use screws, fastening devices, large nails, or adhesive materials (except 3M Command removable adhesives) in or on the Unit, place signs, displays, or other exhibits, on or in any portion of the Premises or surrounding yard without the prior written consent.

10. CONTRACT EXTENSION
RESIDENT must request an extension in writing to the Director of Housing on or before March 1st. If DRURY agrees to extend the Contract, RESIDENT will be required to sign a new contract with new financial terms.

11. HOLDING OVER
The Premises shall be considered vacated only after all areas including storage areas are clear of all RESIDENT'S belongings, and keys and other property furnished for RESIDENT'S use are returned to DRURY. Any hold over after the Contract Term without the consent of DRURY shall be construed as a tenancy from month-to-month at a rent of twice the current rent outlined in this agreement.

12. INSURANCE
RESIDENT acknowledges that neither DRURY nor DRURY’s insurance company, cover personal property damage caused by fire, theft, rain, war, acts of God, acts of others, and/or any other causes. RESIDENT is advised to obtain renter’s insurance to cover any personal losses. RESIDENT is advised to keep all exterior doors locked when not in the Unit.

13. RIGHT OF ENTRY AND INSPECTION
DRURY may enter the Premises at any time in case of emergency and suspected abandonment. If RESIDENT makes a report to Facilities, such report automatically gives permission for the appropriate staff to enter the Premises during business hours until the work order or issue has been resolved. Security officers will enter once a month on a Saturday or Sunday between 11am – 3pm to inspect fire extinguishers, as required by law. In all other cases, DRURY will endeavor to provide reasonable notice to RESIDENT before entering the Unit. Notice is typically communicated via Drury email, but may include a phone call or note on the door.

14. ASSIGNMENT
RESIDENT agrees not to transfer, assign or sublet the Premises or any part thereof.

15. CAMPUS-WIDE POLICIES
Since the Premises is on DRURY’s campus, RESIDENT must know and follow all campus-wide policies. RESIDENT is responsible for ensuring all additional tenants, guests, and invitees follow all policies. Policies are available at www.drury.edu/communitystandards.

16. ALCOHOL & DRUGS
All staff/faculty RESIDENTS will follow the DRURY Alcohol Policy & Drug policies, as amended as follows:

• Faculty/staff RESIDENTS and their invitees should abide by all local, state, and federal laws.

• Use of alcohol is permitted in the Premises by persons of legal age, with the door closed.

• Faculty/staff RESIDENTS should not actively interact or be in the company of those who they know to be underage who are consuming or possessing alcohol, or consume or possess alcohol themselves in the presence of those underage. Furthermore, extreme caution and good judgment should be used when consuming or possessing alcohol with students who are of legal drinking age.

• Alcoholic energy drinks and beverages with 15% or higher alcohol content are not permitted on campus, however, as professional staff members, faculty/staff RESIDENTS may possess and consume them if all the above stipulations are met.

17. INDEMNIFICATION OF DRURY
RESIDENT will release, defend, hold harmless, and indemnify DRURY, its Trustees, officers, directors, employees, agents, and all of those acting by or on behalf of DRURY from and against any and all claims, actions, damages, liability and expense in connection with personal injury or damage or loss to property arising from or out of this Contract, any occurrence at the Premises, or due to the negligence or intentional acts of RESIDENT, additional tenants, RESIDENT’s invitees or guests, including claims arising in whole or in part from DRURY’s negligence.

18. COMPLIANCE WITH LAW
RESIDENT agrees to comply with all local, state, and federal laws pertaining to RESIDENT’s use and occupancy of the Premises. RESIDENT agrees not to have or allow any third party to have illegal drugs or substances on the Premises. RESIDENT agrees that breach of this Section will constitute an incurable breach of this Contract requiring immediate surrender of the Premises to DRURY and immediate vacation of the Premises by RESIDENT.

19. DEFAULT OF RESIDENT
In the event of any failure by Resident to pay any rental due here within five (5) days after the same shall be due, or any failure to perform any of the other terms of this Contract for more than five (5) days after written notice of default, then DRURY, besides other rights and remedies it may have, shall have the immediate right of re-entry in accord with applicable law. Should DRURY terminate this Contract under this Section, DRURY may recover from Resident all damages caused by RESIDENT’s breach of this Contract, including for damages to the Premises, loss of use of the Premises and other damages.

20. ENTIRE AGREEMENT; AMENDMENTS
This Contract constitutes the entire agreement of the parties as to the transaction contemplated herein and supersedes any and all understandings or agreements, if any, oral or written, between the parties relating to the subject matter of this Contract. This Contract may only be amended by a writing signed by both RESIDENT and DRURY.

21. ENFORCEMENT
In the event either party obtains legal counsel to enforce this Contract, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs in pursuing enforcement from the non-prevailing party.

The undersigned RESIDENT and additional adult tenants have read and understand this Contract and hereby acknowledge receipt of a copy of this Contract.
